AN eight-month pregnant woman from Old Pumula in Bulawayo reportedly died during a private prayer session with a self-proclaimed prophet in her bedroom.Close relatives say Lindiwe Nkomo, 35, a member of an apostolic sect in the suburb, had complained of stomach pains before she invited the prophet to her house for prayers on Thursday morning.
 According to family members, a postmortem report states that Nkomo’s womb raptured and that she needed urgent medical attention. Witnesses said the prophet, John Jiri, prayed for Nkomo for nearly three hours until she died.

“We heard him (Jiri) praying loudly from 12 noon until 3PM while she groaned in pain,” said a neighbour who declined to be named. The neighbour said it seems nobody bothered calling an ambulance to take her to hospital.

“After 3PM we went to inquire and the prophet said she had taken a nap. A few minutes later a relative joined the prophet and they continued praying for her until they realised she was not waking up,” said the neighbour.

The neighbour said they later told Jiri to call an ambulance to take Nkomo to hospital.“The ambulance came around 4PM and the paramedics confirmed her dead,” said the neighbour. Narrating her sister’s ordeal, Nomsa Moyo said her sister told them after their morning prayers that her baby was pushing upwards.

“We went for morning prayers in the bush and on our return she told us that the baby was pushing upwards. She instructed us to apply sheep fat on her stomach,” said Moyo. She said her sister also said she was feeling hot and they poured cold water on her.

“We prepared porridge for her but she could not  eat and  asked to be taken to her bedroom so she could rest,” said Nomsa. Lindiwe’s landlord, Precious Nkomo said   when they realised she was not feeling well, they resolved to call Jiri to pray for her thinking her problem was spiritual.

“We called Jiri to pray for her but when the situation deteriorated we called an ambulance but it seems it was already too late,” she said. Nkomo’s visibly shocked husband Mkhululi Ndlovu said he was absent when his wife died.

“There is nothing I can tell you because I was in South Africa during the time of her death. There can be speculations but I am not in a position to condemn the prophet because I was not there,” he said.
Jiri said he indeed prayed for Nkomo hoping she was going to get well.

“There is nothing I can tell the Press because I executed my duties as a prophet. Unfortunately Nkomo died after the prayer session. We called an ambulance and they  told us she was dead,” he said.
Comment could not be obtained from  the police.


Battle lines have been drawn between MDC-T secretary-general Tendai Biti and organising secretary Nelson Chamisa over the recent suspension of two Manicaland provincial leaders on charges of indiscipline.
Last month, Chamisa suspended Manicaland provincial chairperson Julius Magarangoma and spokesperson Pishai Muchauraya accusing them of promoting divisions in the province.
Muchauraya landed himself in trouble after he denounced national spokesperson Douglas Mwonzora in the media.

 But the two threatened to disregard their suspension and on Saturday reportedly stormed a provincial meeting addressed by acting chairperson Shuah Mudiwa claiming they were still in charge.
In a letter dated March 14 addressed to all the party’s provincial executive Biti said Chamisa had no locus standi to expel or suspend party organs as that responsibility fell under the secretary-general’s ambit.

“Pursuant to my letter of the 5th of March 2014, attached herewith out of an abundance of caution, I write to reiterate the position of the party with reference to the suspension and expulsion of members and the dissolution of party organs,” Biti wrote.

“It has come to the attention of the party that some members of the party have received letters of suspension, which letters are devoid of reasons of suspension. “It has also been brought to our attention that some provincial executives are being purged for unclear and unsubstantiated reasons.
“Our party constitution is very clear in terms of processes of expelling and suspending members and dissolving party organs.

“In terms of Article 6,4,2,1 of the party constitution, only the national council has the powers to dissolve or suspend any party organ. Thus, in the absence of a decision from the national council, such suspension, expulsion or dissolution is null and void.”

But Chamisa yesterday said the party’s constitution gave him the authority to expel, suspend and dissolve party organs.  He said the decision to suspend Magarangoma and Muchauraya had the backing of the MDC-T standing committee.

 Mwonzora also defended Chamisa’s suspensions saying he was empowered to do so by the MDC-T constitution.

“In the MDC we do not allow hate language against anybody in public and in such cases, the organising secretary has the right to generate a letter of suspension of any person who is suspected of unconstitutional behaviour,” he said.
Mwonzora insisted that Magarangoma and Muchauraya’s suspensions would stand.

POLICE in Mashonaland Central province said they were investigating an alleged attempted rape incident that occurred on March 6 involving an expectant mother and an expatriate doctor at the Salvation Army Church-run Howard Hospital.


Senior Assistant Commissioner Lee Muchemwa confirmed the incident, adding that investigations were still in progress. Meanwhile, the alleged victim, a 22-year-old pregnant woman, told NewsDay last Friday that the suspect, Zairemthiama Pachuau, had prior to the incident sent her nine love messages on her mobile phone.

“I went for a scan in the evening with four other women and I was the last one to be attended to,” she said. “When I went in, he locked his door and asked if I had seen his messages. I asked him why he was doing that and by then, he had undressed. I pushed him and fought. I was so shocked,” she said.
“He used to send me messages and I responded thinking it was my husband who was texting me. He started sending messages like, ‘babe, you are beautiful and attractive’.

“He sent another one saying ‘Hi babe how was your dinner’ and continued sending messages up to the ninth one. I only responded to three of his messages because I thought I was chatting with my husband,” she said.

Asked how he got her number and why she responded to his messages, she said: “When I went to his office, he asked for my phone and dialled his number on my phone so that my number would appear on his and I think that’s how he got it.

“He tried to force himself on me, but he could not. I think he thought I was in love with him because I was responding to his messages. I went to the police not to report him, but to have them assist me in explaining to him that I did not love him, but when I got there, the matter had already been reported by other people.”

Salvation Army officials at the hospital refused to comment over the matter describing it as sensitive.
The church officials briefly detained the two NewsDay journalists who were investigating the matter, accusing them of trespassing.


A 28 year old Playboy model whose butt was used to hit a golf ball is now suing them .Elizabeth Dickson, 28, is suing Playboy Enterprises and radio host Kevin Klein for $500,000 plus punitive damages after he whacked her in the behind with a golf club while trying to hit a ball off a tee placed between the cheeks of her buttocks during an amateur golf tournament in California.
The model claims in a copy of the lawsuit that she gave no consent for the ball to actually be hit and that she has suffered pain, worrying and anxiety as a result of the incident.
Dickson was invited to the Playboy Golf Finals held March 30, 2012 at the Industry Hills, according to the complaint. Klein is a co-host of the Playboy Morning Show.She complied with a request early in the day to lie ‘flat on her stomach with her buttocks partially exposed for a photograph’ with Klein.
‘A golf tee was then placed between the cheeks of her buttocks and a golf ball was balanced on top of the tee.

Dickson was led to believe that the pose would include only a depiction of Klein hitting the ball of the tee for a picture, and not him actually swinging the golf club – but he did swing the club, and he missed badly.‘[Dickson] sustained severe bodily injuries, a portion of which are permanent,’ according to the lawsuit.

The unidentified 69-year-old Chinese man miraculously survived after hammering three 10cm long nails into his own head.
As you can see in the original X-ray picture, the nails were hammered through the man’s skull and into his brain.
Amazingly after the surgery he totally recovered three months after the incident!
Although the man insisted that he had done the whole thing himself, hospital staff believe the injuries could have been inflicted by someone else because of their severity.

A devout Muslim man is being accused of killing his lesbian daughter and her girlfriend at his home. The bodies of Britney Cosby (pictured right in the pic) and Crystal Jackson (pictured left), both 24, were found behind a Dumpster in Texas on March 7th, but police believe they were killed somewhere else and later dumped there.

James Larry Cosby has been arrested and charged with two counts of evidence-tampering and police are planning to upgrade his charges to capital murder once they finish their investigation as all fingers point to him as the murderer because evidence has so far shown that the ladies were killed in his home. His daughter died from blows to the head while her girlfriend died from a gunshot wound.

It was the girl's mother that suggested to police that James Cosby may have killed the girls because he'd said to her a few times that he hated that his daughter was in lesbian relationship and became enraged after the ladies moved in together. She said father and daughter didn't see eye to eye and argued a lot about her sexuality. Cosby had even once attacked Crystal at his home.

Investigators went to the father's house after obtaining a search warrant and found blood and other evidence that suggested something had happened at the home. They found blood on the walls, on the sofa and on the speakers. They also found writings condemning homosexuality.

The police officers seized a hammer and noticed a missing window shutter. A similar shutter was found covered in blood and bearing James Cosby's fingerprints next to the women's bodies.

Cosby, who has a long criminal history, had been released from prison about five months ago.



A 17-year-old Nigerian girl Forester Samson (pictured above) was stabbed and burnt to death in Moscow, Russia by yet to be identified Russian gangstars, according to a report by Sunday Sun.

Sunday Sun gathered that she was murdered by yet-to-be-identified Russian gangsters. According to a family source, the perpetrators went further to lock her body in a room and set it ablaze. Though, the police took her to the hospital, it was rather futile.
The source revealed that Forester was sponsored abroad by one Mercy who is suspected to be trafficking Nigerian girls on the promise that she would assist them with decent jobs in Russia. The teenager without hesitation, but with the approval of her mother jumped at the offer with high hopes.
According to the deceased’s elder sister, Sonia Samson, they got a call from Mercy, on Tuesday March 4, 2014 that Forester had died in an inferno. She added that the family was later told that Forester was stabbed before being set ablaze.

Sonia said, “Her madam is the one that called us on Tuesday and told us she was locked in a room and set ablaze by some unknown Russians. She told us that she was rushed to the hospital, that they were treating her.

“Later that day, she also told us that she was initially stabbed before she was burnt. Not too long after, she told us that she was dead. The madam said she was not the only victim in the attack. She said there were five other Nigerians, that another one died four or five days after the attack.

“My sister died mysteriously, just as another sister of mine was also killed by armed robbers. Sincerely, I am confused because I don’t know why all this is happening to us. Particularly for me, it is so painful that I don’t really know what to say or do. This is a difficult time for the family and I believe we need to be more prayerful more than ever before.”

The late Forester, who would have been celebrating her 18th birthday on March 30 hails from Igbekhue in Orhionmwon Local Government Area of Edo State. She completed her secondary education in 2013.

Forester’s father, Friday Osazuwa Samson was killed four years ago in Benin by suspected armed robbers. He was shot in broad daylight in front of his shop at Upper Sakponba. Until Friday’s death, he was a successful businessman, a distributor with Sona and Bendel breweries.

Siblings and other relatives of the late Forester’s father are worried and pained by circumstances surrounding how Forester was lured into traveling to Russia, which they described as shady. Recognizing the fact that she did not travel to Russia for further education, even as they were not also informed of such plans, they are calling on concerned authorities to wade into the matter.

They are accusing Mercy of human trafficking and calling on National Agency for the Prohibition of Trafficking in Persons (NAPTIP) to investigate the activities of this said Mercy. They also want the Nigerian Embassy in Russia to as a matter of urgency unravel the mystery surrounding the death of their daughter.

The dastardly act took place on March 3, 2014. Since the news broke, the entire family has been thrown into mourning.

Sonia, who still finds it difficult to believe that her sister was gone, lamented that Forester’s death was too painful for her to easily accept. To her, she would have better been dreaming and be glad that the story was not true.

Meanwhile, Forester’s uncle, Mr Saturday Samson Osazuwa accused Forester’s mother of conniving with the said madam (Mercy) to deceive and persuade the teenager to travel abroad. He queried why Forester’s mother, Elizabeth, decided to hide his niece’s whereabouts from him. Saturday, who now acts as a father figure to the children since their father’s death, said the mother refused to disclose where Forester was, even as he insisted on seeing her.

Said he: “The mother was aware that Forester had traveled abroad. Not just that, I believe she was part of the arrangement that her 17-year-old daughter should travel abroad. It is really unfortunate and wicked of her to have taken that decision.

“If my brother, her husband was alive, he would never allow such a thing for any of his children. What was Forester looking for in Russia? Was it to go there and school? Certainly not. Now, she has caused the entire family pain and sorrow. The girl was beautiful and intelligent. I still cannot understand what she was sent to Russia to do at her tender age.

“For more than five months, her mother was dribbling me whenever I wanted to see Forester. I sent for her to come and see me on a number of occasions but they kept telling me that she was residing with her mother’s relatives in Benin here only for me to receive a call from them that she was dead in a fire accident in Russia. This is the girl that they kept telling me was in Benin. Until her death, the mother refused to tell anybody in our family. If she thought that the children belonged to her alone, that is where she’s mistaken.”

Also, an uncle of late Forester’s father, Mr Evabayekha Christopher, described Forester’s mother as callous. He wondered why any reasonable mother would send her own daughter abroad for monetary reasons.

His words: “What exactly will Forester be doing abroad when she was supposed to be studying at the University of Benin or any other higher institution of learning in Nigeria? What she did is unacceptable to every member of our family.”



Mr Mordecai Mahlangu

Leading medical aid society, Cimas, is embroiled in a nasty boardroom wrangle stemming from the alleged flouting of its constitution through the illegitimate appointment of some directors, some of whom work for related companies.Board chairperson Mr Mordecai Mahlangu admitted last week that matters were not handled well in aspects of their operations.

Questions have also been raised about a plan to give a South African company a US$15 million contract to install an IT system at Cimas.
It is further alleged that Cimas offered shareholding to the South African firm, but was not eager to comply with Government’s indigenisation law.

In addition, Gill Godlonton and Gerrans law firm, where Mr Mahlangu is a partner, was given a contract to work for Cimas.
The issues could affect service delivery for members who contribute millions of dollars monthly in subscriptions.

Board member Mr Chester Mhende questioned during a board meeting of September 19, 2012 why the medical aid society wanted to engage South African health insurance company, Medscheme, to install an IT system at a cost of US$15 million over five years.

“At current rates, the society needs to earn US$3 million per annum just to break even,” the minutes say.
“The cost of the new system will most likely become a heavy burden for the society.”

Mr Mhende, in a letter to Mr Mahlangu — which The Herald is in possession of — said the society was not following its constitution, citing the “irregular” appointment of three board members.

Mr Mhende claimed that Mr Matts Valela, Mr Bart Mswaka and Ms Emma Fundira were nominated to sit on the board, but were never endorsed by Cimas members until a year had already lapsed.


He said the board then tried to make fresh nominations ahead of the 2013 annual general meeting in a bid to regularise the anomaly.
Mr Mhende said at one of the AGMs, the three participated in endorsing Mr Mahlangu and his deputy Mr Eben Makonese.

“The question then is, how does the board seek to now correct the irregularity of the appointment of the chairman, and in the process make fresh nominations?” asked Mr Mhende.

“I believe that if my concerns are correct regarding the legality of the board, the decisions of the board since the last AGM may be illegitimate.”

In the same letter – dated February 19, 2014 – Mr Mhende claimed that seven of 12 board members were representing the same interests since they came from related companies – Delta, Old Mutual and CABS.

Old Mutual has significant shares in Delta, while it owns CABS.

“This means the board has seven members who come from the same stable, compromising rational debate and decisions, placing at issue fair play and good corporate governance,” said Mr Mhende.

Mr Mhende further said hat board member Mr Tim Johnson, who is the chairman of the medical aid board, also chairs the audit committee, creating a scenario where he audits himself.

In his response last week, Mr Mhlangu said there was oversight in Cimas’ operations, including in appointment of board members.

“When you pointed this out after the AGM of 2013, the board acknowledged the error and rectified it by once again nominating the three individuals to the board, as it was entitled to do,” he said.

On the shares offered to South Africa’s Medscheme, he said the deal was still in the pipeline and that Cimas was aware of the country’s 51/49 indigenisation law.

“We will have to be satisfied also that any proposal we place before our members and the transaction that we may propose will not violate the laws of Zimbabwe, including any indigenisation and empowerment legislation,” he said.

Cimas is Zimbabwe’s second-largest medical aid society and is owned by its members, handling millions of United States dollars monthly.

MDC-T leader Mr Morgan Tsvangirai has gagged members of the opposition from giving interviews to the public media claiming it’s opening the party up to attack.This is not the first time that Mr Tsvangirai has launched an attack on any media that criticises his actions.

Mr Tsvangirai said this while introducing MDC99 leader Mr Job Sikhala, Mr Edward Mkhosi and Mr Siyabonga Malandu Ncube to a small group of supporters at Stanley Square in Makokoba, Bulawayo at the weekend.

The MDC-T leader, who used to attract crowds that almost filled White City Stadium in Luveve, this time failed to draw enough people to fill the less than 5 000-seater Stanley Square.

“If you do things that are praised by Zanu-PF, you should know that you are wrong. If you are given positive coverage by The Herald, you must know that you are wrong. The same applies to the ZBC, if they give you positive coverage, you should know that you are also wrong.

“If you hear people saying you are doing wrong things, ask yourself if this makes Zanu-PF happy or sad. If by coming together makes Zanu-PF mad, then you must know that you are doing the right thing,” he said.

Mr Tsvangirai also took a jibe at his secretary-general, Mr Tendai Biti, though without naming him directly, for admitting that MDC-T lost the July 31, 2013 elections fair and square.

The MDC-T leader is fighting to suppress a rebellion that insiders say is backed by Mr Biti and deputy treasurer-general Mr Elton Mangoma and reportedly bankrolled by treasurer-general Mr Roy Bennett, who is in self-imposed exiled in South Africa.


Last week, Mr Biti admitted at a public meeting in Harare that Zanu-PF won the elections on the basis of its stronger policies.
But Mr Tsvangirai retorted: “If old villagers understand that the elections were rigged, why do senior people refuse to acknowledge that?

“They say ‘he-e internal democracy, he-e constitutionalism’. Why are you not seeing dictatorship in Zanu-PF? Why are you not seeing Zanu-PF stealing the elections.

“There are some who always say I want that position and that person who holds it must go. We do not want that. We do not want to push people out of the tent,” said Mr Tsvangirai.

He said some leaders were creating chaos in the party in the name of promoting democracy.

“There is nothing wrong with different opinions in the MDC, but let’s have direction. Democracy is not mobocracy . . . We condemn indiscipline in the party. We need this party to move on. If you are in the MDC you are a child of the party and you must commit yourself to the values of the struggle,” he said.

Interestingly though, Mr Tsvangirai is yet to condemn party members who assaulted Mr Mangoma and other officials as he looked on in Harare recently.

In fact, MDC-T spokesperson and Tsvangirai loyalist, Mr Douglas Mwonzora, is the lawyer representing the men accused of assaulting Mr Mangoma.

While The Herald could not get full details, insiders said the meeting in Bulawayo had been scheduled to start at 9am and end at 2pm but was delayed because the leadership was locked in a stormy meeting.

Trying to play down the poor attendance, MDC-T organising secretary Mr Nelson Chamisa claimed: “Zanu-PF, in an attempt to stop people from attending our meeting, went around with some flyers saying the meeting had been postponed.”

Three Navistar Insurance Brokers Limited directors, who were implicated in the Air Zimbabwe (Private) Limited multi-million dollar aircraft insurance scandal, were on Friday granted bail by the High Court.
Justice Joseph Musakwa ordered the release of managing directors Givemore Nderere (45) and Vukile Hlupo on US$5 000 bail each, while the company’s finance director Orten Mawire was granted US$1 000 bail.

Nderere and Hlupo were ordered to report daily at Criminal Investigation Department’s Serious Fraud squad, while Mawire will report thrice a week.

The trio was warned not to interfere with investigations and State witnesses.
They were ordered to surrender their travel documents and title deeds to their respective properties as surety.

Harare lawyer Mr George Mhlanga represented the trio, while Mr Innocent Muchini of the National Prosecuting Authority acted for the State.
The three are facing four counts of fraud and one of theft.

State claims the trio connived with Air Zimbabwe bosses Peter Chikumba and Grace Pfumbidzayi to defraud the national airline by inflating aviation insurance premiums.


It is alleged that the group presented several inflated debit notes to the airline, leading to payments of exorbitant aviation insurance premiums last year.

The payments were allegedly made to Colemont Reinsurance (Private) Limited and Marsh Reinsurance Brokers (Private) Limited, both United kingdom-based companies.

Prosecutor Michael Reza told the court that as a result of the misrepresentation, the airline’s finance department released Euro 15 783 452,93 to Navistar.

According to state papers, Navistar only remitted Euro 10 607 859, 22 to the two international brokers and pocketed Euro 5 895 695, 49.
In May 2009, it is alleged Navistar received US$142 300 from the airline for onward transmission to the European Commission to dodge sanctions.

They allegedly converted the money to their own use.
The court heard that Pfumbidzayi and then Air Zimbabwe acting chief executive Innocent Mavhunga originated fictitious debit notes in the sum of US$1 659 276, 58 in 2012.

The money was reportedly requested for the aviation insurance premiums for two leased A320 Airbus.
The transaction was reportedly intercepted by auditors, but the airline had already released US$360 448, 68, the court heard.

It is further alleged that Colemont Insurance issued debit notes to Air Zimbabwe for aviation insurance premiums between 2009 and 2010, after the Navistar trio allegedly connived with Pfumbidzayi and Mavhunga for the payment of aviation insurance in the sum of Euro 713 921, 04.

An HIV positive Harare man is forcing his wife to have unprotected sex with him because he is allegedly allergic to condoms. The couple is HIV positive.
Maxwell Jairos said condoms were not good for his health as they affected his manhood.
His wife Esther Chingondo approached the Civil Court yesterday seeking a protection order against her husband whom she also accused of verbal abuse.

“He forces me to have unprotected sex with him every time despite the warning we were given by medical practitioners that we should always have protected sex,” she said.


“Whenever I refuse to have unprotected sex with him he takes a scissors and cuts my undergarment and forces me to sleep with him.
“He does not take his tablets saying they affect his skin and he also denies me a chance to take mine. Sometimes if I refuse to sleep with him he starts assaulting me and the children and insulting us with obscene words.”

Jairos, who did not deny the charges, admitted that condoms were not good for his health.
“I am allergic to condoms because they affect my manhood and that is why I resorted to unprotected sex,” he said.

Magistrate Ms Gamuchirai Siwardi granted Chingondo the protection order and barred Jairos from physically, sexually or verbally abusing her.

While Malaysian Prime Minister Najib Razak refused to confirm that flight MH370 was taken over, he admitted 'deliberate action' on board the plane resulted in it changing course and losing connection with ground crews.

The plane's communication system was switched off as it headed west over the Malaysian seaboard and could have flown for another seven hours on its fuel reserves.

It is not yet clear where the plane could have been taken, however Mr Razak said the most recent satellite data suggests the plane could have headed to one of two possible flight corridors.

The last radar contact was made at 8.11am on March 8 along one of the corridors, seven hours and 31 minutes after take off, but the plane could have deviated further from these points.
U.S. investigators have not ruled out the possibility that the passengers are being held at an unknown location and suggest that faint 'pings' were being transmitted for several hours after the flight lost contact with the ground.

NASA has also joined the international search operation, analysing satellite data and images that have already been gathered.

Malaysian authorities and others are urgently investigating the two pilots and 10 crew members, along with the 227 passengers on board.

A Nollywood actress has been forced to come out and explain a picture which has gone viral which shows her in a compromising situation.

The picture shows actress Biola Ige in what would appear to be a compromising situation with actor Muna Ibekwe. The actress said the picture was from a movie scene.


"I was going to remain silent on the photo being displayed on the internet however I realise that I need to set the record straight for my family, friends and fans who I love and respect.

The photo in question was taking from the set of a movie called "Pregnant Hawkers" in which I played a hawker who was in a romantic situation with a man (the actor in the photo). This movie was shot and aired two years ago. The photo circulating the internet right now is the photo from a scene in the movie and nothing more. If you watched the movie you will see that there is nothing to this movie other than the fact that I was playing a role! I am an actress, it is a profession that I love and will continue to enjoy. I am required to play all sorts of roles. In each role I step out of being Biola Ige and go straight into 'character'.


Whoever maliciously leaked this photo to make it appear to be something else has simply given me some great publicity! Thank you!

Members of the public have for the first time been given an opportunity to nominate six people they feel are fit to be appointed judges of the High Court and the Supreme Court in line with the provisions of the new Constitution.

The invitation by the Judicial Service Commission followed changes to the Constitution that were adopted last year when in the past the judges would come from a list recommended by the JSC to the President.

Those interested have up to April 14 to submit completed nomination forms with attached nominee’s curriculum vitae to the JSC. The nomination forms can be obtained from the office of secretary of the Judicial Service Commission at Old Supreme Court Building at the intersection of Kwame Nkrumah Avenue and Third Street.

They can also be obtained at any Provincial Magistrate in charge of a province or by visiting the website: http://www.jsc.org.zw where they can be downloaded. Of the six judges, three will be for the High Court and the other three for the Supreme Court.

“In terms of section 180 (2) of the Constitution of Zimbabwe, members of the public are hereby invited to nominate suitably qualified persons to fill the above positions in the Supreme Court and the High Court,” said the JSC in a statement.

The JSC said section 178 of the Constitution provided that a person was qualified for appointment as a judge of the Supreme Court if he or she was a Zimbabwean citizen and at least 40 years old.
Subsection (1) (a) reads: “He or she has been a judge of a court of unlimited jurisdiction in civil or criminal matters in a country in which the common law is Roman-Dutch or English is an officially recognised language; or (b) for at least ten years whether continuously or not, he or she has been qualified to practice as a legal practitioner- (i) in Zimbabwe; or (ii) in a country in which the common law is Roman-Dutch or English and English is an officially recognised language and is currently qualified to practice.”

In order to be appointed as a judge of the Supreme Court, the JSC said a person must be a fit and proper person to hold the office as a judge. Last month, Chief Justice Godfrey Chidyausiku swore in eight new commissioners of the Judicial Services Commission in compliance with the new Constitution that requires the appointment of 13 commissioners, up from the six who used to run it.

Deputy Chief Justice Luke Malaba, Judge President George Chiweshe, High Court judge Justice Happias Zhou, chief magistrate Mr Mishrod Guvamombe, Law Society of Zimbabwe president Mr Lloyd Mhishi, accountant Mrs Priscilla Mutembwi and two other lawyers — Mrs Priscilla Madzonga and Mr Josphat Tshuma — were the newly appointed commissioners.

CAPS Holdings executive chairman Mr Fred Mutanda has made sensational claims that the Reserve Bank of Zimbabwe collapsed the operations of CAPS Pharmaceuticals after ordering delivery of “all stocks of medicines” to State hospitals about six years ago.

CAPS Pharmaceuticals, once the country’s largest drug manufacturing firm has since ceased operations and its premises in Southerton were once auctioned for $1,5 million. The auction was, however, reversed after the High Court ordered that the sale of the premises should be done through a private treaty.

Government was also reported not to be happy with the business that was likely to be conducted by the winning bidder. While the collapse of CAPS Pharmaceuticals is blamed on poor management and alleged interference by Mr Mutanda, who is also the majority shareholder, the businessman has blamed the actions of the central bank, which he alleged collapsed the company.

CAPS Pharmaceuticals used to manufacture about 75 percent of the country’s essential drugs. In court papers filed at the High Court in which Mr Mutanda is challenging the placement of QV Pharmacies, one of CAPS Holdings subsidiaries, he said the central bank had promised to pay the drug maker in foreign currency to procure raw materials. But the company had to look for funds elsewhere after the central banks failed to pay.

“Around August 2008 the Reserve Bank crippled CAPS Pharmaceuticals after commandeering the delivery of all stocks of medicines to Natpharm to facilitate re-opening of Government hospitals, promising to provide foreign currency for raw materials to replace the delivered medicine and restock the whole product portfolio,” he claims.

“The promised foreign currency never materialised but CAPS was paid months in worthless Zimbabwean dollars, which the company could not access until local currency was demonetised.”
Zimbabwe adopted a multi-currency regime on January 29 2009 in the wake of the collapse of the Zimdollar, and four currencies were adopted – the South African rand, the Botswana pula, the British Pound Sterling and the US dollar.

Government has since directed that CAPS should be re-opened due to the strategic nature of the business. In 2008, most gold mines, including those operated by Metallon, the country’s largest producer of the metal suspended operations due to delays in receiving payments for gold delivered to the central bank which had monopoly on the gold trade. But the miners resumed operations in July 2009 after a new unity Government allowed miners to sell their own bullion.

The RBZ owes gold producers about $50 million, acting governor Dr Charity Dhliwayo said last week. The debt has since been assumed by the Ministry of Finance and Economic Development which will settle all payments.

Former central bank governor Dr Gideon Gono has on several occasions defended his actions. His actions were meant to prevent the country from descending into chaos “like Somalia.”
